All wines collected within the state of Illinois are subject to local sales tax.
Retail Shipments
As your agent, we will be pleased to choose a licensed common carrier on your behalf, with various levels of service typically available. There are times in which certain methods of delivery are not possible. In that event you will be contacted by us within two business day of placing your order.
Please note that most states regulate importation of wines and buyers are responsible for compliance with laws of the state in which wines are shipped to. Buyers, not HDH, are the owners and shipper of record for all shipments.
Shipments will be sent prepaid only if payment in good funds is received prior to shipment. During some periods, processing of orders and payments may require up to two weeks.
At all times, taxation is determined by point of delivery. HDH is required by law to collect the appropriate state and local taxes from purchasers, unless the purchase is deemed to be non-taxable. All non-taxable transactions must be completely documented prior to release of purchases. Buyer acknowledges and agrees to be solely responsible for all applicable excise, use, and sales tax due to any state in relation to any purchase made pursuant to the terms herein. Payment of tax and storage charges, if any, are required prior to release of the wine.
Buyers must also warrant that they are at least 21 years of age, and that the wines will be received by someone that is at least 21 years of age.
Shipment can usually be arranged within 2 business days of receipt of payment and any applicable taxes or permits. It is recommended that buyers collect their wines whenever feasible, as commercial shipment can be risky, especially in the case of older and more fragile wines. Neither Hart Davis Hart Wine Co. nor its agents can assume responsibility for any deterioration resulting from shipment. Insurance will automatically be provided at a nominal charge, which will cover solely breakage or loss during shipment. Wines must be inspected by the buyer upon receipt and any loss or breakage must be noted on the Shipper’s documents. Hart Davis Hart Wine Co. must be notified immediately of any breakage or loss claims. Should this insurance coverage not be desired, a written waiver of insurance and any subsequent claims must be received prior to the shipment of the wines. Without insurance, loss or damage due to any cause will be at the buyer’s risk.
Transporting wine in extreme weather conditions, even by overnight service, may seriously damage wines. During periods of extreme weather, HDH strongly advises against transport of wines by any means. If shipment is requested during periods of extreme weather, the buyer will be required to sign a Shipping Release to free HDH from any liability for damage incurred to wines shipped during periods of extreme weather.
